A woman accused of attempting to kill her mother-in-law by suffocating her with a pillow last year has pleaded guilty to aggravated assault.

Catherine Lucille Hlavenka, 62, received a sentence of 10 years probation from Northeastern Judicial Circuit Superior Court Judge Bonnie Oliver.

As part of the Oct. 31 sentence, Hlavenka must also pay a $4,000 fine, perform 240 hours of community service and have no contact with her now 94-year-old relative.

According to court records, Hlavenka is required to complete anger management and impulse control classes, as well as provide a waiver of consent so the court can obtain her medical records.

District Attorney Lee Darragh said Hlavenka's mother-in-law agreed with the sentence.

In addition, he said statements from the defense that Hlavenka may have been on medication for Parkinson's disease at the time were considered in plea negotiations.

"While the state didn't give that defense a great deal of credence, it was nonetheless taken into account along with the victim's consent to the disposition and request to be handled with probation," he said.

Hlavenka was arrested Sept. 9, 2010, after a nurse caring for the elderly relative notified local authorities of possible abuse.

At the time of the incident, the elderly woman was living with her son and Hlavenka in Big Canoe.
